Funny thing is that whenever i try to find laws about impeding the flow of traffic it applies SPECIFICALLY to using a vehicle to slow or stop traffic or jaywalking. |
Yeah, the only thing I can find seems to be in the context of construction work.
The funny thing is, a Scilon DID block traffic on Delmar when he pulled out in his white Toyota Sequoia and stopped in the middle of the street to yell across two lanes to ask directions from the very officer who arrested you.
An arrest for "failure to comply" assumes the police order was legal and reasonable in the first place.
I'd contact the ACLU if I were you and I did not already have an attorney.

Bumps with update |

been out of touch recently, working hard and whatnot. Reinstalled windows on all my computers (everything is now 64bit, much better then that 32bit garbage i was dealing with before). partly out of distrust of the cops, mostly because i wanted a little performance boost.
anyway, there hasn't really been much to update, i got my ticket a few days after my arrest, and it couldn't be more vague or poorly written. other then that hasn't really been much to update. i mailed a complaint form to the ACLU a few days ago but i am still waiting to hear from them about it. I haven't gotten a lawyer yet because at this point, there really isn't a need for one yet. court tonight is just going to be "how do you plead?" If I plead Guilty then they write me a ticket and I'm off (no fucking way in hell). and WHEN i plead not guilty, they will set a trial date in the future. I will get a lawyer tonight, because honestly, i cant tell from my ticket what i was charged with (I was told at booking that i was charged with "impeding the flow of traffic" but my ticket says "peace disturbance", it might just be a grouping fir the same crime). I'll take the train over tonight to U. City and make a date of it.
Anyway, here is copy of my ticket. I had to rape it in photoshop so it could even be remotely legible.
Court tonight is at 6PM (I was like WTF). If you plan on dropping by and are anonymous, dont introduce yourself to me, my guess is that there will be at least one scilon there if not more. if i know you i know you ill give you the super secret wave or something. Update after court.

First things first, thanks again everybody for your criticism and support. If I had known that you guys were gonna be so awesome, then I would have gotten myself arrested sooner! Hopefully none of us will ever have to deal with a senseless arrest like this again.
SOOOOO...
WHO'S AWESOME?
THE RUNDOWN
So here is what happened tonight. I got to the City of University City City Hall (ugh) about 6.30. Was called to talk to the Judge about 7.15. Said "Good evening, Sir", He read my charge and asked me how I plead to which I responded "Not Guilty, Sir" He told me to wait a moment and I would talk to the Prosecuting Attorney. Had a seat and chilled...wished I had brought the video at that point, I assumed that I wouldn't even talk to anyone this evening, that they would just assign me a trial date and I’d be off. But one of the cops said that if they can get a case squared away tonight then they will try that first. about 8.00 I got my chance to talk to the PA, at first he was ready to set a trial date, even wrote it down on my case file...and then he saw where I was arrested and then started reading through the case file... he was a little surprised when he read the arrest report that actually said that my 18"x24" sign was slowing down traffic. About 5 minutes into it he was talking about not pursuing charges. I told him about our relatively good relationship with the police, our polite encounters with scilons and even our 18 months of peaceful protests. Ten minutes into he says "you know, this isn't anything I can prosecute" WIN. He dropped the charges after speaking to him for ten minutes. we talked for about 25 minutes about our POSITIVE history in U.City, the Westboro Baptist Church-relevant because they won the right to protest at military funerals, the initial fuss that the cops gave anonymous over wearing masks, anons chalking the sidewalks (I’m looking at you Blitz), the scilons apparently haven't even had a problem with us (that they could take to the cops at least). All in all it was pretty enlightening. I left the courthouse, turned on my Zune, and played Michael Jackson's "Beat It", feeling just a little bit more superior than usual.
BUT I DID MAKE ONE CONCESSION
The PA was concerned that until there was a real case about the matter of where we could protest/picket that we might just be arrested again. SO to protect our ability to cross the street and picket but protect the scilons from the hackers on steroids, we agreed that we wouldn't protest on the ORG side of the street unless there was an officer present. It was my suggestion, and I feel that this is more than fair. It protects the scilons and gives us witnesses if there is an altercation (with cops out there won’t be) and the odds of this agreement getting back to the scilons (say for a counter protest) is very low. I never really wanted to speak for the anonymous is this fashion, but I figure that this is more than fair for everyone involved. AND it may mean that the cops wont police the org on Raid dates if we can be legitimately arrested (or at least threatened) for breaking our own rules and being there at times when they are not.
IN CLOSING
So that’s it, if the ACLU wants to follow through with my case then I might let it slide if this agreement works out. I can deal with one asshole cop if the whole thing works out for everyone AND we lose the presence of cops. I think that this has been great experience and look forward to NOT being arrested for speaking my mind in the future.

good job dude.
I think that's a very reasonable compromise. If the cops are there, we can be on their side of the street, and the scilons can't call in stupid shit about us.
Win all around. Glad to hear you won't be dropping the soap.
